Terms and conditions « member space »

1. PREAMBLE

Europa Group places at your personal disposal a « member space » which can be accessed via the web site. This document refers specifically to this space and does not have the purpose or effect of restricting or replacing other documents such as information statements, general conditions of sale, the privacy policy and cookies policy

2. DEFINITIONS

To facilitate the understanding of these member space terms and conditions, it is understood that

• « Member »: any person who has created an account which gives access to their member space;
• « Member space »: the personal space set aside for members, accessed via the web site of Europa Group or the scientific society for which Europa Group is appointed (indicate name), and which gives access to certain information or additional services;
• « Services »: any service offered to the member in the member space.

3. PURPOSE

The purpose of these special terms and conditions is to define the terms of use of the member space.

4. TERM

These terms and conditions are applicable from the moment they are accepted when the user creates his/her account, and until the account is cancelled.

5. OPPOSABILITY

These terms and conditions are opposable as soon as they are accepted by the user, when subscribing to the service.

Europa Group reserves the right to modify these terms and conditions in any way it deems necessary or useful. The version that the member space user may oppose is the one figuring on the web site.

6. CREATION OF MEMBER SPACE

To create a space and become member, users must first create an account, by completing the online form.

Users must ensure the full accuracy of the information they provide when creating an account to access the service.

The creation of a member space via the online form comprises the following steps:

• Step 1: the user completes the account creation form by filling in the corresponding fields, some of which are compulsory, according to the type of services the user selects. The details must be accurate and regularly updated;
• Step 2: the user reads and accepts the terms and conditions by ticking the corresponding checkbox;
• Step 3: once the form has been correctly filled in, the user validates the form and receives an email confirming the account creation – on the email address he/she provides.

7. ACCESS AND USE

Use of the member space is strictly personal and the space is intuitu personae. It is therefore reserved for the sole use of the concerned member and can in no case whatsoever be shared with other users.

The user agrees to use the member space according to the conditions hereby defined and also:

• not to use the space for personal advertising or for the sale of products;
• not to commit any act of forgery, reproduce, download, represent or modify all or part of the member space;
• not to disrupt the smooth running of the member space.

8. USER LOGIN DETAILS

Each member has sole responsibility for the safekeeping and confidentiality of his/her user login details and commits to taking all necessary steps to ensure their strict confidentiality.

User login details are strictly personal and confidential; any previous use of them will be presumed carried out in the user’s name.

If a password is forgotten or its secrecy compromised, the user can modify it by following the procedure indicated on the web site.

Furthermore, users are advised to modify their password on a regular basis, to ensure its full effectiveness and security.

9. CANCELLATION OF MEMBER SPACE

Users can close their account at any time by sending an email to the following address: contact@linnc.com

Whatever the reason for the cancellation of an account, it will entail the loss of all data, information and access to member space services.

Europa Group reserves the right to cancel a member space at any time if the user does not comply with the terms and conditions defined hereby.

Furthermore, Europa Group may withdraw any content that contradicts these conditions and any other applicable laws.

10. PROPERTY

The structure of the member space and all content added by Europa Group remains its own property.

The information and content added by the user remains his/her property.

11. RULES OF EVIDENCE

Connection data, logins and other technical data are considered by all parties as being of probative value.

This provision should be considered as a rule of evidence.

12. PERSONAL DATA AND COOKIES

Personal data entered in the member space is collected by Europa Group according to their data protection policy, and in their role as process controller.

Europa Group fully complies to the laws relating to personal data protection, in particular the General Data Protection Regulation.

13. SEVERABILITY

14. GOVERNING LAW AND APPLICABLE JURISDICTION

These terms and conditions are governed by French law.

This applies to substantive and procedural principles, regardless of the location where the fundamental or subsidiary obligations are performed.

Any dispute concerning these terms and conditions will be addressed under French jurisdiction.
